By using our website design services, you agree to the terms and conditions set forth in this Terms of Service agreement (the "Agreement").
Ownership of Website
All website designs, templates, graphics, images, and other content created by VIVATRONIA ("Design Agency") for its clients are the exclusive property of the Design Agency until otherwise agreed upon between the client and VIVATRONIA.
Non-Payment
Clients are responsible for paying all monthly or owed fees associated with the website design services provided by VIVATRONIA. In case of non-payment, VIVATRONIA will provide a grace period of 10 days to allow the client to make the necessary payment. If no payment is received during this grace period, we may pause or shut down the website until payment is received.
Content Approval
VIVATRONIA will not post any content or materials on the website until the client approves them. The only exception is the bottom bar that mentions the website was built by the Design Agency, which will be posted on all websites created by the Design Agency.
Content by VIVATRONIA
All websites created by VIVATRONIA will include a static bar at the bottom at each website that mentions the website was built by us. The bottom bar will remain in place at all times and can only be removed with agreement between the client and VIVATRONIA.
Limitation of Liability
VIVATRONIA will not be liable for any direct, indirect, incidental, special, or consequential damages arising out of or in connection with the use of our website design services.
Modification of Terms
The Design Agency reserves the right to modify or update these Terms of Service at any time without prior notice.
Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the United States of America, without giving effect to any principles of conflicts of law.
